billerbeck Schweiz AG: General Terms and Conditions

The following terms and conditions apply to all sales/deliveries to private customers:

1. Orders
Orders are only considered binding once our order confirmation has been sent electronically. We reserve the right to request an advance payment or a payment security before accepting an order.

2. Prices
Switzerland/Liechtenstein
All prices include the legally required sales taxes. The prices shown on our order confirmation are binding.

Other countries (excluding Switzerland/Liechtenstein)
All prices are exclusive of sales tax and any other charges required by specific countries.

3. Payment conditions
Switzerland/Liechtenstein
Deliveries will be made against an invoice, payable within 30 days of the invoice date (unless otherwise stipulated on the order confirmation). Payments must be of the net amount shown on the invoice with no deductions. No discounts or other reductions will be given unless these are expressly mentioned on the order confirmation. We reserve the right to insist upon a differing method of payment.

Other countries (excluding Switzerland/Liechtenstein)
Deliveries will be made against credit card payments or payment in advance. Payments must be of the net amount shown on the invoice with no deductions. No discounts or other reductions will be given..

4. Deliveries and delivery dates
As a general rule, deliveries are made within 5 (Switzerland) to 10 (other countries) working days. Customers will be informed about any unexpected delays by email. If delivery is delayed by more than 30 days, the customer has the right to cancel the order. If, for some reason, the product can no longer be delivered at all, the customer will receive an email offering an alternative product, comparable in both price and quality. If we do not receive information to the contrary within 10 days, we will assume the alternative product offer is acceptable. The customer has no further right of claim for delivery delays or hindrances.

5. Transport and transport costs
All risk of loss or damage during carriage is borne by the ordering party. Claims for any damage incurred during delivery can only be made against the delivery company and do not justify a price reduction. Deliveries will be made by post or by courier service. A fixed delivery charge will be levied for each delivery. This will be shown on the order confirmation.
For orders with a value in excess of 1500.00 Euro, no transport charges will be levied

6. Change of ownership
All products remain the property of billerbeck Schweiz AG until the total invoice amount has been paid in full.

7. Defects, returned goods, exchanges
Manufacturing defects or incorrect deliveries must be reported immediately and at the latest within 5 days of receipt of the goods. Defective or incorrectly delivered goods will be replaced with correct goods as soon as the faulty goods have been returned. They will be despatched free of shipping costs. Customers have no further right of claim. Duvets and pillows are hygiene articles - therefore correctly delivered goods can only be exchanged if they are returned unused and in the original packaging. All transport costs incurred for the exchange must be paid for by the customer. In addition, billerbeck Schweiz AG has the right to claim up to 10% of the value of the goods as reimbursement for extra costs incurred.

8. Data protection
billerbeck Schweiz AG handles all customer data in accordance with the legal requirements set out in the data protection law. billerbeck Schweiz AG only uses and saves data which are necessary for the correct functioning of our day to day business and financial transactions. 9. Applicable law / Place of jurisdiction
Swiss law applies to all contractual relations between billerbeck Schweiz AG and its customers. The place of jurisdiction is Fischbach-Göslikon.
